Protecting Children from the net

I personally think the whole questing about what is considered obscene and indecent is getting way out of proportion. I was never aware about a specific beer being illegal in New York because of the label on the bottle, apparently that label on the bottle has a frog giving the middle finger, so the alcohol committee decides to ban the distribution of this beer.

In February of 1995 Senator James Exon introduces the Communications indecency act. This act does not deal with obscenity but it deals strictly with indecency. Exon argues that most people in this debate never even logged on to the internet, so he went and downloaded some hardcore and disturbing pornographic files, and invited them to come view them.

The act that is being proposed states “any comment, request, suggestion, proposal, image or other communication that, in context depicts or describes in terms potentially offensive as measured by contemporary community standards sexual excretory.” In a round about way this act states that if anyone shows pornographic images to a child they will be sent to 5 years in jail and a 250,000 fine.

Motley Crue Indecency issue

I found this article about the band Motley Crue, and how on New Years Eve this year the lead singer, Vince Neil yelled the F word while doing a live performance on NBC’s Tonight Show. The band is arguing in court that NBC is discriminating against them because they are musicians, and past guests have done the same offence on their network, and received no punishment equal to theirs. NBC issued a statement saying they have to right to decide if the band can be invited back on their network.

Many lawyers are wondering if this case will make any change in FCC’s indecency regulations. Federal judges are expected to decide what constitutes indecency.

I think that Motley Crue is receiving a way to harsh punishment for their actions. This occurrence happened between the periods of 10 p.m. to 6 a.m., witch is in The FCC’s “safe harbor” period. I think this is a violation of Motley Crues First amendment rights, just because they expressed their opinions that people didn’t like, doesn’t mean they should be punished for it. Hopefully this court case can clearly identify what is considered indecent.

Indecency in our community

Its funny how words that are used everyday by people are banned from radio and television net works. I don’t think that that FCC should be able to regulate what kind of language we hear, when we listen or watch T.V. What they consider to be inappropriate and obscene may be what we are looking to hear. The definition of Obscenity is different to all, I think it all depends on how we are raised and brought up.
I being raised in a large metropolitan city was brought up around obscene language there for it is part of my lifestyle. Where as some one being raised in a not so populated area was not exposed too much of this obscene language. This may make people resentful towards the use of this language.

In this lecture I found some of the zoning laws interesting. Porn businesses have rights like everyone does and you cannot take rights away. People cannot just say they do not want pornography businesses in their community. People cannot use zoning laws to get rid of adult entertainment; they could only make it difficult for someone to start a business.

Obscenity

In this lecture we discussed censorship and regulations set by government and libraries. Roman Censors where people who worked for the Roman Empire, and where responsible for who is allowed to become a ruling leader. One censor was observed kissing his wife in public and therefore stripped of his title. The index of forbidden books and authors is another example of censorship; this index was used as a basis to prosecute. The list included 500 books that where not allowed to appear in libraries. Most of the books are offensive to the church, that’s why they appeared on the list. The Areotagitica speech was also a response to censorship, this speech was a reaction to a set of laws that require a license to print. Hugh black was considered a 1^st amendment absolutist. He stated that free speech means free speech. Another absolutist was Alexander Meiklejohn. He stated that the first amendment was designed to protect political speech. He thought there could be limits to freedom of speech. Government can’t put restrictions on what people say but can put restrictions on when, what time people use their 1^st amendment right. This means you can’t go into a building and scream fire.

Lecture 19 talked about the consequences that go along with the child pornography business. In 2000 a member of the band the Who was arrested for his involvement with a child pornography investigation. Operation Avalanche was an action against Landslide productions. Landslide productions were a child porn AVS site. Johnson did not think anything was wrong with his involvement with this site since they did not shoot the porn, or purchase any child porn rights. All Landslide productions did was provide you with access to other Child porn sites. In the takedown of this production company that United States postal service was involved. Landslide productions were involved with distributing child porn related items through that mail, and the postal service assured that. It was discovered that landslide productions had approximately 350,000 subscribers, and each subscription cost 35 dollars, there for making them a 20 million dollar a year business. They did not make their money from creating child pornography but from distributing it, and giving access to it. Johnson was convicted and originally got 15 years for every image that he had on the site, but later got reduced to 15 years for every site he provide on his own wed site.

Throughout the semester I have noticed that Forgottendaze's blogs have been very straight forward and easy to understand. When looking at people’s blogs I noticed a lot of them start with in lecture so and so……I also took into consideration the amount of spelling and grammar errors, and how creative the author was when discussing a topic.

In lecture 18 I find it interesting how Dr Al Cooper states that Internet porn is as addicting for some as crack cocaine is. The internet has a huge impact in today’s society, Dr. Cooper has came up with the three A’s of porn addiction. The first is Access, people no longer have to go to stores, dial up to the internet, and search through magazines to find porn. Most people today have internet access in their homes, therefore they have 24/7 access to the world of porno. Affordability is another part of Dr. Coopers three A’s. Porn is so easy to find, its quick to find, and also most of it is free. The last part of the three A’s is annimity witch means it’s convenient because people can’t see you and know what you are doing.

I think the whole being addicted to porn thing is a little ridiculous. For example the case mentioned in the lecture about a professor being charged because he was looking at child porn in the universities labs. It was proven that he has a disability in which he is compulsive when is come to looking at porn. Its one thing if he is looking at maxims web site, but he isn’t he is looking at child porn. This guy has to know that looking at child porn is a huge crime, and when you look at it in a university lab chances are you are going to get caught.

I was never aware of the advertising and marketing needed to start an adult affiliate site. There are so many different pieces that make up adult affiliate site such as affiliate networking, leasing content. Hosting, advertising traffic exchange, search engine placement, and spam. All for these parts have to be just right in order for an individual to see a profit. If you have good content but no networking you site is as good as nothing. You are not going to make an empire out of an affiliate site, maybe just some short-term cash.

I personally feel that advertising is the most important aspect if you are going to want to see and income from your site. You can have the best site in the world and if no one knows about it, you’re not making the money. Most affiliate sites are used to get people to come to other sites. For example if you advertise for bang bros on your site, and get and individual to sign up with their network, bang bros will give you 50% of their membership fee. The advantage for bang bros in doing this is they get money on a continual basis, for you exploiting your ability to draw traffic to their site.

Is it possible break into the porn industry and make money? Breaking into the industry is not an easy task. Only a few have made a breakthrough in the industry and earned profits. Jill Kelly is one of few who became very successful in a short period of time, she went public in 2004. The production of porn is difficult because you have to always be producing in order to see a profit. There is almost always at least a $10,000 production cost. In order for a producer to make good money on their films they have to try to cut loose of the middle man (networks, rental shops, and distributors), and start distributing their products through the mail.

When a star makes it into the porn industry, they usually grow from their. For example Jenna Jameson went from the porn industry to Hollywood. Yeah she did not do it over night but she used it as a stepping stone to make it big. Some may say once your in the industry you are in it for good, I agree with this. Look at a big porn star like Jenna Jameson, she does Hollywood movies, but everyone knows her from her porn films.

Business side of porn

The American porn industry was started in the 1820’s William Haynes. Haynes was the first pornographer of the United States. His first porn that made it to the United States was Fanny Hill. Fanny Hill was smuggled into the United States by a ship captain in the 1820’s. William Haynes published and authored a total of 320 Books. Many say the reason for his success was because he started at the right time because there was no competition. William Haynes ended up killing himself as a result of a letter Anthony Cometock sent to him saying he was going to get arrested for this pornography business. Anthony Cometock was an inspector for the United States mail, and had the power to arrest people. He was a one man obscenity seeking machine, and cause 16 pornographers to commit suicide. With the inventions of trains, planes, and automobiles it was almost impossible to keep up with pornography entering the United States. As a result of this Comstocks power trip comes to an end. To this day in the United States there are sill Cometock laws in effect, but very different. In the 1930 2 magazines are imported. One is Nudist at 25 cents a copy. Nudist was the first porn magazine available at news stands in the US. The second magazine was Esquire magazine at 50 cents a copy. This was the second most expensive magazine. There are 2 effects of these magazines; one being everyone could get access to porn. And second Pornography being sold over the counter has to be more extreme now. WW2 time period raised Hugh Heffner. He wanted to start gentleman’s magazines, HE had 600$ and went to a calendar industry and bought rights to Merlyn Monroe for playboys first issues centerfold. Heffner went to stores in person and ended up selling 50,000 copies of the magazine at 50 cents each. Playboy became the best seller in its first issue. Heffner made 100 million in just 4 years, and again this happened to be the right time for him.
